Terms of Service

Welcome to SimPT. These Terms of Service ("Terms") govern your use of the SimPT clinical reasoning simulator at simpt.us (the "Service"), operated by 3D Medical LLC, an Idaho limited liability company ("SimPT," "we," "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What SimPT is — and is not

SimPT is an educational simulation tool for physical therapy students and clinicians. It presents fictional, computer-generated patient encounters for practice and learning.

• SimPT is NOT medical advice, diagnosis, or treatment. Nothing in the Service should be used to make decisions about real patients.
• Simulated patients are fictional. Any resemblance to real persons is coincidental.
• Cases and automated feedback are educational content that may contain imperfections or errors. Scores and debriefs are formative practice feedback — they are not a credential, certification, licensure preparation guarantee, or an official academic assessment unless your institution independently designates them as such.
• Case content is not clinically vetted by SimPT, and SimPT does not verify the credentials or licensure of any user who authors or shares a case.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. You agree to provide accurate information at signup, keep your login email current, and not share your account. Sign-in links sent to your email are for you alone. You are responsible for activity on your account. Some features require an invite code; codes may be revoked or expire.

3. Acceptable use

You agree not to:

• Attempt to extract, reverse-engineer, or scrape case content, grading logic, prompts, or ground-truth data;
• Probe, overload, or circumvent rate limits, access controls, or usage metering (including creating multiple accounts to evade free-tier limits);
• Use the Service to build a competing case library or dataset;
• Share, resell, or publicly post substantial portions of case content or scored debriefs without permission;
• Misrepresent your credentials (e.g., claiming licensure you do not hold when accepting a clinician-role invitation);
• Use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms.

4. User feedback and endorsements

The Service may ask for your feedback on cases (e.g., whether a simulated patient presented realistically, or reports that something seems clinically off). You grant us a perpetual, royalty-free license to use feedback you submit to operate and improve the Service. Endorsement counts shown in the Service are aggregate user feedback, not clinical review.

5. Authored cases

If you have case-authoring access, you retain ownership of the original case content you author (such as case briefs and clinical scenarios you write). You grant SimPT a perpetual, irrevocable, worldwide, royalty-free license to host, store, adapt, reproduce, display, and use your authored content to operate, provide, and improve the Service, including generating simulated encounters and grading from it and, where you choose to share a case, making it available to other users. The SimPT case format, generation engine, grading system, and platform remain SimPT's property. You represent that content you author does not infringe third-party rights and contains no real patient information.

6. Intellectual property

The Service, including software, SimPT-authored case content, grading rubrics, and design, is owned by SimPT or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal educational purposes (or, for institutional customers, as set out in the applicable agreement).

7. Subscriptions, free tier, and payment

• Free tier: each account includes two (2) graded case evaluations on library cases, plus unlimited use of designated free content. Evaluations of cases you authored yourself do not count against your free tier.
• Paid plans: monthly and annual subscriptions unlock additional graded evaluations and features as described at purchase. Prices are shown before purchase and may change with notice; changes apply at your next renewal.
• Subscriptions renew automatically until canceled. You can cancel anytime, effective at the end of the current billing period.
• Refunds: within 14 days of your FIRST purchase, contact [email protected] for a full refund. After that, payments are non-refundable and cancellation stops future renewals; we do not prorate partial periods.
• Payments are processed by Stripe; we do not store full payment card details.
• Student or institutional pricing may require verification of eligibility.

8. Availability and changes

The Service is provided on an evolving basis. We may add, change, or remove features, cases, or scoring approaches, and may suspend the Service for maintenance. We aim for high availability but do not guarantee uninterrupted access.

9. Third-party services

The Service uses third-party providers, including AI model providers (Anthropic), cloud hosting (DigitalOcean), email delivery (Resend and ImprovMX), and payment processing (Stripe). Their processing of data is described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF EDUCATIONAL CONTENT, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT SIMULATED CASES, FINDINGS, OR AUTOMATED FEEDBACK ARE FREE OF CLINICAL ERROR, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR ACADEMIC OR EXAMINATION OUTCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR ACADEMIC OPPORTUNITY, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50 IF YOU HAVE PAID NOTHING. Some jurisdictions do not allow certain limitations; these apply to the fullest extent permitted.

12. Indemnification

You will indemnify SimPT against claims arising from your breach of these Terms, your misrepresentation of credentials, or content you author or submit.

13. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate access for breach of these Terms, with notice where practicable. Sections that by their nature should survive (IP, disclaimers, liability limits, indemnity) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Ada County, Idaho, and the parties consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. Material changes will be announced via the Service or email, with the effective date updated above. Continued use after the effective date constitutes acceptance.
